During its irregular meeting on July 20, Cabinet discussed and supported the revised rule for issuing permits to start and continue construction and putting buildings and facilities into operation, according to the Ministry of Construction and Urban Development.
It includes regulations for a number of issues that have arisen during the implementation of the rules.
Particularly, the following regulations are included in the rule on issuing permits to start and continue construction, and commissioning process.
• In accordance with Article 10.1.5 of the Law on Construction, the state central administrative body in charge of construction shall issue a permit to start and continue construction on the basis of a request from the local governor, or Ulaanbaatar mayor.
• The state central administrative body in charge of construction shall issue a permit for construction work of constructions related to Article 20.2 of the Construction Law.
• A request for a construction permit under Article 32.1.5 of the same law shall be submitted to the state central administrative body in charge of construction through the relevant state central administrative body and shall be resolved by Cabinet.
• The issue of issuing a permit for an unlicensed building shall be decided by a court.
• The state administrative organization in charge of construction shall put into operation buildings and facilities under Articles 10.1.5, 20.2 and 32.1.5 of the Law on Construction on the basis of a technical commission’s conclusion.
• The number of commission members in charge of commissioning will be reduced.
The Ministry of Construction and Urban Development believes that the start and continuation of construction of strategic and national-specific facilities will be prioritized and the delays will be reduced.
It provides an opportunity to commission a complete facility, monitor the implementation of tasks, improve quality control by one step, and eliminate violations of legal documents and duplication of activities, the ministry noted.
