Court Decision Enforcement Law amended

During its plenary session on October 29, Parliament passed draft amendments to the Law on Court Decision Enforcement and Law on President of Mongolia, as well as the revised Law on Seeds and Varieties of Plants.

The amendment to the Law on Court Decision Enforcement provides for the improvement of social security for officers of court decision enforcement and creation of conditions for stable employment. Under the law, a cash bonus equal to 30 months’ basic salary will be distributed every five years to officers, who have been working constantly for five or more years in areas other than Ulaanbaatar city and provincial centers.

Article 12.18 of the Law on President of Mongolia, which stipulates that the president of Mongolia shall appoint and dismiss the head and members of the Judicial General Council (JGC), has been in conflict with the revised Law on Courts. Therefore, the Law on President of Mongolia was amended to eliminate the conflict between the laws.

The Constitutional Court accepted President U.Khurelsukh’s request to cancel his predecessor’s veto invoked on the revised Law on Courts of Mongolia during its meeting on September 24. In February 2021, former President Kh.Battulga had put a partial veto on the Law on Courts. On April 28, the Constitutional Court ruled that the provisions related to the appointments of JGC memberships violated the constitutional principle for the allocation of state power, but Parliament rejected the conclusion on May 6. 

Last Friday, bill initiators also introduced a draft revision of the Law on Seeds and Varieties of Plants. Head of the working group in charge of the bill and lawmaker J.Bat-Erdene noted that the current Law on Seeds and Varieties of Plants cannot regulate issues related to the protection of gene pool of cultivated plants, creation of new varieties, seed purification, seed quality control, certification, seed stockpiling and disposal, or the testing, registration, ownership and use of new varieties.

The draft revision of the law contains 31 articles and was developed to support the development of the crop seed sector, advance research, analysis and innovation in the sector, promote fair seed trade, protect and sustain the use of plant genetic resources, and coordinate relations to ensure food security.

It also includes conditions for seed quality control, certification, seed trade, new regulations on seed import and export, registration of national varieties, protection of new varieties of crops, and granting of copyright to varieties.
