During its plenary session on March 26, Parliament appointed J.Erdenebulgan as member of the Constitutional Court of Mongolia at the nomination of the Supreme Court. The appointment was made based on Article 65.1.2 of the Constitution, Articles 3.1, 4.2 and 4.4 of the Law on Constitutional Court and Article 102 of the Law on Parliamentary Procedure.
In addition, Sh.Tsogtoo, whose term of office has expired, was relieved of duty as member of the Constitutional Court.
Speaker of Parliament G.Zandanshatar thanked Sh.Tsogtoo for his service as member of the Constitutional Court, and said, “I would like to ask the newly appointed member J.Erdenebulgan to respect the Constitution of Mongolia, to fulfill his duty to protect the Constitution independently. The Supreme Court needs to discuss a proposal to appoint another member of the Constitutional Court of Mongolia in the near future.”
On the same day, President of Mongolia Kh.Battulga sent an official letter to Speaker of Parliament G.Zandanshatar, stating that he decided to veto the parliamentary resolution on exemption and appointment of the Constitutional Court.
He noted in the official letter, “In accordance with Article 65.1 of the Constitution, the Constitutional Court consists of nine members. Three of them shall be nominated by Parliament, three by the president and three by the Supreme Court, and appointed by Parliament for a term of six years. Members of the Constitutional Court D.Solongo and Sh.Tsogtoo, whose term of office has expired, were nominated by the Supreme Court. When the court nominates the next member, it must clearly state to Parliament which member to dismiss. I believe that the Constitutional Court, which is a guarantee of freedom, should be set up without legal violations and disputes.”
In this regard, the president sent an official letter for clarification to the Supreme Court. “Please submit official position and proposal of the Supreme Court on the dismissal of D.Solongo and Sh.Tsogtoo, and the appointment of the next member to the president of Mongolia,” the letter said.
Director of the Law School of the National University of Mongolia, PhD J.Erdenebulgan graduated from the National University of Mongolia with a bachelor’s degree in law in 1994. He obtained his master’s degree in law in 1995 and doctorate in law in 2012.
J.ERDENEBAT APPOINTED AS MEMBER OF INDUSTRIAL POLICY STANDING COMMITTEE
During the session, Parliament passed parliamentary resolutions on changing the composition of standing committees and subcommittees.
In accordance with the resolution, J.Erdenebat was appointed as member of the Standing Committee on Industrial Policy, Deputy Prime Minister S.Amarsaikhan was exempted from the Subcommittee on Voter List and Registration Control, and G.Ganbold was appointed as member of the subcommittee.
Moreover, Parliament set up a temporary committee with 24 members to monitor the implementation of the parliamentary resolution on ensuring Mongolia’s interests in the development of the Oyu Tolgoi deposit.
The temporary committee led by parliamentarian Ts.Davaasuren includes lawmakers Sh.Adishaa, N.Altankhuyag, P.Anujin, Yo.Baatarbileg, B.Bat-Erdene, J.Bat-Erdene, Kh.Bolorchuluun, S.Byambatsogt, J.Ganbaatar, S.Ganbaatar, G.Ganbold, N.Ganibal, Kh.Gankhuyag, G.Damdinnyam, B.Delgersaikhan, B.Jargalmaa, J.Munkhbat, Ts.Sandag-Ochir, J.Sukhbaatar, G.Temuulen, Ch.Undram, S.Chinzorig and B.Enkhbayar.
In addition, a bill on ratification of the Tenth Additional Protocol to the Constitution of the Universal Postal Union was passed.
